Employment Law Update: Sexual Harassment

Recently the Equality and Human Rights Commission (EHRC) issued updated guidance to assist employers in preventing sexual harassment at work.

On 26th of October 2024 the Equality Act 2010 was amended to impose a positive duty upon employers to prevent sexual harassment.

Employers will need to demonstrate they have taken reasonable steps to prevent such sexual harassment. If they cannot do this an Employment Tribunal can uplift any compensation awarded by up to 25%.

The EHRC have published template guidance for employers to adapt. This comprises a checklist, action plan and monitoring log.

The aim of the templates is to complement existing HR policies and help employers protect their organisation and work force.

It is likely that these steps will be born in mind should a claim be brought.
