Unfortunately, not all marriages are successful and many end up with divorce. If you are unsure whether you want a divorce, or do not understand how a divorce works, then Jacksons can offer practical and confidential legal advice.  We will ensure you have a clear knowledge of the process and what is required of you and your spouse. In order to be eligible for a divorce, you must have been married for more than one year, living permanently in England & Wales, and your marriage must be recognised as valid in the UK. You need to show a Court that your marriage has irretrievably broken down and this is established by one of the following five facts:

  1. Adultery
  2. Unreasonable behaviour
  3. Desertion
  4. Separation two years
  5. Separation five years

Once the divorce petition is submitted to the court, the process thereafter is mainly administrative.  For a non-contested standard divorce there is no need for you to attend court. Once the Final Decree (Decree Absolute) has been pronounced, then the marriage is brought to an end and you are legally divorced. This means you will be free to re-marry if you wish.

We do offer in some circumstances a Fixed Fee package. This will be offered depending on the complexity of the individual case and will be discussed in your initial consultation with a member of our family law team.
